Workers' Compensation Overview

There is a common misconception that the workers' compensation system in Oklahoma is "dead" and no longer available to the injured worker, or benefits have been taken away from injured workers to the point it is no longer "worth it" to file a claim. This could not be further from the truth! The Oklahoma workers' compensation system is very much alive and well, and provides many benefits to those who are injured on the job.

While it is true that some benefits have been reduced or eliminated over the years, there are still many valuable benefits available to the injured worker. These include medical benefits, wage replacement benefits, and death benefits. The Oklahoma workers' compensation system is an essential resource for injured workers and one that should not be overlooked.

Workers' compensation is incredibly complex and should NOT be navigated by the injured worker without a licensed workers' compensation attorney to act as their advocate, fighting for all possible benefits.

If you have been injured on the job, you have several fundamental rights:

• You have the right to have a lawyer fighting for you and your family in this difficult time. A personal injury lawyer can help you navigate the legal system and fight for the compensation you deserve. With an experienced advocate on your side, you can focus on healing and moving forward with your life.

• You have the right to get medical treatment for each part of your body injured in the accident. This may include broken bones, whiplash, head injuries, and more. Do not let anyone convince you to downplay your injuries or refuse treatment.

• You have the right to get a "second opinion" on each part of your body that was hurt in the accident. Getting a second opinion can ensure you get the best care for your injuries. In addition, a second opinion can help identify any potential problems the first doctor may have missed. Ultimately, getting a second opinion is a personal decision. Still, it can make a big difference in the outcome of your case.

• You have the right to get weekly TTD (temporary total disability) checks while you are off work treating for your injuries. TTD benefits provide compensation for lost wages and can help you cover your living expenses while healing from your injuries.

• You have the right to be reimbursed for any out-of-pocket expenses related to medical treatment for your injuries. After suffering a personal injury, the last thing you want to worry about is how you will afford medical treatment. Fortunately, you have the right to be reimbursed for any out-of-pocket expenses related to your injury. This includes expenses such as doctor's visits, prescription medication, physical therapy, and hospital stays.

• When your medical treatment is all over, you are entitled to monetary compensation (a settlement) for the permanent disability you suffered because of the injury. The amount of money you receive will depend on a number of factors, including the severity of your injuries, the length of your recovery, and the impact that your injuries have had on your ability to work and enjoy your life.

• In some cases, you can even keep your medical treatment open after your case is over. Many personal injury cases are resolved relatively quickly, with the patient receiving the necessary treatment and then moving on with their lives. However, in some cases, the injured party may need ongoing medical care that extends beyond the resolution of their case. In these instances, it is often possible to keep your medical treatment open after your case is over. This means that you can continue receiving the care you need without worrying about the costs.

• There are many more benefits as well. If you have any questions about what expenses are covered, be sure to ask your personal injury lawyer.

Maybe most important - you have a right to have your day in Court!

Personal Injury

Insurance companies are in the business of making money. To do that, they take in as much money in premiums as possible and pay out as little as possible in claims. One of the ways they do that is by delaying, denying, and underpaying valid claims. They will do whatever it takes to save themselves money, even if it means leaving policy holders high and dry.
